In a decisive move to curb worsening air quality in the National Capital Region, the Supreme Court has reinstated the ban on vehicles compliant with Bharat Stage 3 (BS3) and older emission norms. With this ruling, such vehicles are no longer permitted to operate in Delhi-NCR, while BS4, BS6 and newer vehicles remain unaffected.
The decision comes after concerns were raised over a sharp increase in pollution levels following the court’s earlier order in August 2025, which had temporarily protected BS3 and older vehicles from regulatory action. That relief has now been withdrawn.
Why the ban has been reinstated
During a hearing on Delhi-NCR’s deteriorating air quality, Additional Solicitor General Aishwarya Bhati urged the apex court to reconsider its earlier stance. The plea was based on recommendations from the Commission for Air Quality Management (CAQM), which observed a clear rise in pollution after enforcement agencies were restrained from acting against older vehicles.
Accepting the CAQM’s assessment, the Supreme Court bench led by Chief Justice Surya Kant ruled that continued operation of BS3 and older vehicles posed a significant environmental risk, especially during periods of high pollution.
